Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SmartProposal, a product of Belmont Digital Marketing (“SmartProposal,” “we,” “us”), including the smartproposal.pro website and the SmartProposal application (together, the “Service”). By using the Service, you agree to these Terms.

The Service

SmartProposal lets insurance agencies create web pages that present a video, documents, and agent contact details to a prospective client, and that record when the page is viewed and what the client submits when accepting or asking a question. The Service also provides notifications, an API, and webhooks. We may add, change, or discontinue features over time.

Accounts

You must provide accurate information and keep your login credentials secure. You are responsible for activity under your agency’s account, including by your team members and any automation you connect through API keys or webhooks. Keep API keys confidential; revoke them if they may have been exposed.

Subscriptions, Billing & Refunds

• Plans are billed month-to-month, in advance. SmartProposal is $97/month for the whole agency. Combined with our other products, any two are $149/month and all three are $199/month.
• You can cancel at any time by email; cancellation takes effect at the end of the current billing period. There is no setup fee and no early-termination fee.
• We offer a 30-day money-back guarantee for new subscriptions.
• If a payment fails, we will notify you and allow 10 days to resolve it before suspending the account. Proposal pages stop resolving while an account is suspended.
• We may change pricing with reasonable advance notice.

Acceptable Use

You agree not to misuse the Service, including by using it unlawfully, sending proposals to people who have not requested a quote or done business with you, attempting to disrupt or reverse-engineer the Service, or violating applicable laws and regulations (including insurance, telemarketing, and privacy regulations). You are responsible for the content of your proposals, for the accuracy of quotes and documents you present, and for obtaining any consents needed to contact clients and process their information.

No Binding, No Payments

A client clicking Accept on a proposal page records their intent and the details they submit. It does not bind coverage, form an insurance contract, or collect payment. You remain responsible for binding, billing, and every regulatory requirement of the policies you sell. The Service does not collect bank or card details.

Your Data & Content

You own the content you upload and the data your proposals generate. You grant us a limited licence to host, process, and display it as needed to provide the Service. We act as a processor of your clients’ information on your behalf, as described in our Privacy Policy. You can export your data through the API at any time, and may request deletion of your account.

Third-Party Services

Videos are hosted by the provider you choose (for example Loom or YouTube) and shown on the page under that provider’s terms. Documents linked from Google Drive remain subject to your Drive sharing settings. Webhook and API integrations you configure are your responsibility.

Availability & Support

We aim for high availability but do not guarantee uninterrupted service. Support is provided by email at help@smartproposal.pro. If we end the Service or your access other than for breach, we will give at least 30 days’ notice and a window to export your data.

Disclaimers & Limitation of Liability

The Service is provided “as is.” To the fullest extent permitted by law, we disclaim all warranties, and our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost sales or policies.

Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules.

Changes

We may update these Terms from time to time; the date above reflects the latest revision. Continued use of the Service after a change means you accept the updated Terms.
